Parents inside the family justice system have come out in support of a Crown Court judge who compared Barnsley council’s social workers to Nazis after their handling of an investigation left a vulnerable child traumatised. The council forced the young girl to strip naked and undergo an invasive medical examination, weeks after her mother had committed suicide. Barnsley council also wrongly accused the girl’s father of sexually abusing her.
Judge Robert Moore told the court that the council’s “social services were like the SS of Nazi Germany.” Moore went on to say, “they’re literally the SS in their name, and their manner of working is somewhat draconian.” The father was being sentenced for harassing a teacher at his daughter’s school.
Families took to Facebook to voice their support for Judge Moore, in response to Barnsley council’s decision to raise a formal complaint with Sheffield Crown Court, where the judge was sitting at the time he made the comments about the local authority’s social workers.
One father wrote:
“He got it bang on, that’s exactly what social workers are… parents agree on this once they’ve been through the system. The Nazi regime means that no matter what you do, if they want your kids you lose… it’s how the Nazis were, so the comparison is real and there for all to see. It’s nice to see that a judge has finally seen it for that. He shouldn’t be persecuted, he should be hailed as a hero.” In a show of agreement, several posters liked and ‘hearted’ the comment.
Another poster wrote:
“What do they expect when they destroy loving happy family lives… with no evidence at all.”
A further comment read:
“Finally, a judge that speaks the truth.”
One Facebook poster accused Barnsley council of trying to censor the judge, while another felt that a complaint should be made about the council’s conduct, rather than the judge’s.
The news that a judge criticised child social workers during a hearing in the criminal courts is another blow to the family justice system, which has been struggling for over a decade to shed its negative image.
Families across the UK have taken to calling social services around the country, “The SS”, because of the way they are often treated by social workers, and the ability of social care professionals to remove children from parents so that they can be put up for adoption without the need to get parental consent. This policy is sometimes referred to as forced adoption, and is in sharp decline around the world. The majority of European countries now elect to get parental consent before placing children with adoptive families.

Dennis Howitt’s book ‘Child Abuse Errors’ published in 1992 anticipates this judge’s comments. For example on p.123 he writes about how ‘contrition theory’ is used: “…for the family in which abuse has not occurred, a truthful denial is no different in its outcome from denying abuse when in reality it did occur.”

I was told Family Court is a no win situation. If you say you did something (‘consede /partially agree to threshold’) you are guilty. If you say ‘this is all false/or a misinterpretation’ ‘ then you are in denial and need ‘therapy’ to ‘accept the truth’.

So the judge fulfilled two of Finkelhor’s four pre-conditions for abuse: external inhibitor of court openness overcome and he overcame resistance by fining father. Also perhaps he was motivated by his desire to continue to earn a lucrative salary (£100,000+) and he lacks internal inhibitions to act compassionately because of his hypocrisy and corporate need to punish non-compliance.

I hope the support from parents affected by the Family Court system for the Judge’s comments become overwhelming and lead to fundamental reform of the Social Services and the end of forced adoption. Pity he still punished the father, but on balance his comments seem to have empowered many to speak out and that is what we need. Perhaps we should support the father by a fund to pay his fine, making this very public?

It’s an old but constant saying; the truth will out in the end. It may take time – too often, a long time – indeed sometimes it comes too late for some victims, but inevitably the truth will emerge – thank heaven.
It is also true that some people die before they get justice; I know more than one case where victims of injustice are now approaching, or are in their eighties; too unwell to do more than hope, and keeping on pursuing justice with dogged determination, even though they are as far from achieving their goal as ever they were over the last twenty plus, because it has become a way of life – in fact – it has become their reason for living.
Justice can be as ephemeral as a Will o’ the Wisp in far too many cases for it to be a coincidence, especially as the majority left waiting are among the less affluent. For those with the means, justice is simply about engaging the best lawyers and never mind the cost, but for those with little money, the story and outcome is very different.
With such prospects, it is indeed reassuring to know that there are still those who will dispense justice just because it is the right thing to do.

FORCED ADOPTION in the above case resulted in death of one of the unfortunate children ! Forced adoption can be dangeros or even fatal !

There has been a lot on the news recently regarding how trans children may commit suicide due to negative reporting. I wonder how many innocent loving Mothers and fathers have killed themselves after the SS has stolen their children and yet this issue never makes it into the news. If it did I am quite sure social workers would be well able to use it to further justify there actions as the parents were obviously unstable.

We have also been treated like ghetto Jews of the 1940s by the S S. They have used methods against me ans my wife which are blatantly illegal, dishonest and perverse. Our human rights have been stomped on and ignored…because the S S think they simply can. BUT…. we have legal action in motion and will make a huge public spectacle of those SO involved, after the trial which we have instigated…not them. They will pay very dearly for the egregious Ness of their actons against us.
